These Terms and Conditions (“Terms”) govern your use of Launch Website (“we”, “our”, “us”) and the services we provide. By using our website or services, you agree to these Terms.
1. Services
We offer website design, development, launch, and related services as described on our website. Specific deliverables, timelines, and pricing are confirmed in writing in your project proposal or quote.
2. Quotes and Proposals
All quotes are valid for 30 days from the date issued. A quote becomes binding only when you accept it in writing and pay the agreed deposit (if applicable).
3. Client Responsibilities
To launch a project on time, you agree to:
- Provide content, branding assets, and feedback within the timeframes agreed
- Respond to questions within 2 business days
- Make payments on the dates agreed
- Ensure any content you supply is yours to use and does not violate any third-party rights
4. Payments
Unless otherwise agreed, projects require a deposit before work begins, with the balance due before launch or as set out in your proposal. Ongoing services (maintenance, hosting, retainers) are billed monthly or quarterly. Late payments may incur a 2% monthly fee.
5. Revisions and Changes
Each proposal includes a defined scope and revision count. Additional revisions or scope changes are billed at our standard hourly rate or as a fixed change-order, agreed in writing before work proceeds.
6. Ownership
Once final payment is received, you own the design and content delivered for your project, with the following exceptions:
- Third-party assets (fonts, stock images, plugins) remain subject to their original licences
- We retain the right to display the work in our portfolio and case studies unless you request otherwise in writing
- Underlying code frameworks, libraries, and reusable components remain our intellectual property
7. Hosting and Domains
Hosting and domain registration are separate from design and development. We can arrange them on your behalf, but you are responsible for ongoing renewal fees billed by your hosting and domain providers.
8. Cancellation and Refunds
You may cancel a project in writing at any time. Refunds are calculated based on work completed up to the cancellation date. Deposits are non-refundable once project work has started.
9. Warranty
We warrant that delivered work will substantially match the agreed proposal and will be free of major bugs at launch. We provide 30 days of free bug-fix support after launch. After 30 days, edits and fixes are billed hourly or via a maintenance plan.
10. Limitation of Liability
Our total liability for any claim arising from your use of our services is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental losses, including loss of profit, data, or goodwill.
11. Confidentiality
Both parties agree to keep confidential information shared during a project private and to use it only for the purpose of delivering the project. An NDA can be signed on request before sensitive information is shared.
12. Intellectual Property
You confirm that any content, logos, images, or other materials you provide are yours to use. You indemnify us against any third-party claims arising from materials you supply.
13. Termination
We may suspend or terminate services if you breach these Terms, fail to pay for more than 14 days after the due date, or use our services for illegal purposes.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which Launch Website is registered. Disputes will first be addressed through good-faith negotiation; if unresolved, they will be settled in the courts of that jurisdiction.
15. Changes to Terms
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
